摘 要:教育法律关系主体权责的精细划分是教育治理现代化的必然要求。我国高校研究生导师制在推进过程中遭遇了现实的挑战,权力的分化与错位导致了师生关系的冲突和失调。研究生导师制的责权划分,其核心是界定研究生和导师等主体的学术权利和学术责任,在此基础上,明确高校及研究生管理部门的职责。导师与研究生的教育法律关系具有特殊的属性,导师与研究生的责权界定既需遵照相关的法律和制度规范,又具有较大的弹性空间。高校导师与研究生的权责边界及研究生受教育权的保障离不开国家义务和权利救济制度的建设。研究生导师制的责权边界与弹性空间有赖于形成更为清晰的法律规范。The fine division of the powers and responsibilities of educational subjects is an inevitable requirement for the modernization of educational governance.The postgraduate tutoring system in our country has been challenged by the reality in the reform process.The differentiation of power brings conflicts and integration of teacher-student relationship.The division of graduate student and tutors'rights is mainly to define the academic rights(power)and academic responsibilities of the two subjects.On this basis,the responsibilities of the university and graduate management departments are clarified.The relationship between tutors and postgraduates in Education law has special attributes.The responsibilities of tutors and postgraduates are defined,and they have greater flexibility in relevant legal and institutional norms.The authority and responsibility of the supervisors and graduate students in universities in China depend on the formation of clear legal norms.The guarantee of the right to education for graduate students should establish the right relief mechanism when the State's obligations are violated.
