摘　　要：日本政府福岛核废水排海决策及未来排海行为涉嫌违反国际法。国际法却无力阻止日本福岛核废水排海,体现国际法实施面临现实障碍:一方面,国际法并未得到严格遵守;另一方面,国际违法行为的认定及国际法的强制实施都非易事。然而,国际法必将发挥重要的作用,这是因为:人类命运共同理念更加深入人心,国际核安全法律体系日臻完善,国际核安全法的约束力显著增强。在此背景下,中国应推动国际社会坚持人类命运共同体理念,完善国际核安全法律体系,加强多元主体的监督作用,促使日本遵守国际法。Japan’s decision to discharge Fukushima nuclear wastewater and its future action to discharge are suspected of violating the international law.The inability of international law to prevent Japan’s nuclear wastewater from being discharged into the sea reflects the practical obstacles faced in the implementation of the international law:on the one hand,the international law has not been strictly observed;and on the other hand,the identification of international violations and enforcement of the international law are not easy.However,the international law is bound to play a more important role with the common destiny of mankind being more deeply rooted in the hearts of the people,the international nuclear safety legal system improving day by day,and the binding force of the international nuclear safety law being significantly strengthened.China should promote the international community to adhere to the concept of a community with a shared future for mankind,improve the international nuclear safety legal system,strengthen the supervisory role of multiple subjects,and urge Japan to abide by international law.
