摘 要:我国历经革命型、运动型、政策型和法治型四种刑事治理模式。其中,革命型、运动型和政策型刑事治理模式具有“非法治”的缺陷,因而应采取法治型刑事治理模式。法治型刑事治理模式存在积极预防型和消极预防型两种面向。积极预防型刑事治理模式在理论根据、刑事立法与刑事司法等方面存在不足,易导致刑法过度介入社会治理。消极预防型刑事治理模式以人权保障为核心并恪守刑法谦抑主义,值得提倡。刑事治理应与其他治理手段相互融合以实现社会治理的多元共治。China has experienced four criminal governance modes of revolutionary type,movement type,policy type and rule of law.Among them,the revolutionary,the movement and the policy criminal governance model have the defect of "anti-rule of law",so we should adopt the rule of law criminal governance model.The mode of criminal governance based on the rule of law has two aspects:active prevention and passive prevention.The active preventive criminal governance model has some deficiencies in theoretical basis,criminal legislation and criminal justice,which can easily lead to excessive involvement of criminal law in social governance.The passive preventive mode of criminal governance is worth advocating because it takes protecting civil liberties as the core and abides by the modesty of criminal law.Criminal governance should be integrated with other governance means to realize the multi-governance of social governance.
