摘　　要：该文以温州蔡某申请个人债务集中清理案为例,对个人破产制度在我国的现状进行介绍,通过分析个人破产制度建立的理论基础,得出当前我国个人破产制度建立还存在个人破产评估确认标准未明、财产登记系统不完善、社会征信体系不完善、后续保障制度未成体系等障碍,结合中外法律实践在立法上设定个人破产的评估标准、规定失权、复权制度、完善破产保障措施、建立配套法律体系的建议,以期对个人破产制度在立法上的构建提供参考。This paperTaking the case ofthe applicationof a person in Wenzhou with the family name of Cai for the centralized liquidation of personal debts as an example,this paper introduces the current situation of the personal bankruptcy system in China.Through the analysis of the theoretical basis of the establishment of the personal bankruptcy system,it points out that there are someobstacles in the establishment of the personal bankruptcy system in China,such as unclear evaluation and confirmation standard,imperfect property registration system,underdevelopment of social credit systemand incomplete follow-up protection system,etc.Besides,this paper combines Chinese legal practice with foreign legal practice to legislate personal bankruptcy evaluation standards,stipulate loss of power,restoration of power,improve bankruptcy protection measuresand establish a supporting legal system soas to provide advice and suggestions on the legislative construction of the personal bankruptcy system.
