档案保管、移交、封闭、保密期限的矛盾关系与优化策略

摘　　要：我国现有法律法规中关于档案的保管期限、移交期限、封闭期限、保密期限等时间规定之间存在着诸多矛盾与冲突。文章以新《档案法》《保密法》《档案法实施办法》《信息公开条例》等相关法律法规为分析对象,围绕文书档案的保管期限、移交期限、接收条件、封闭期限、保密期限、政府信息公开期限等核心概念,进行现状梳理与分类讨论,归纳出三类矛盾,并针对这些矛盾对《档案法实施办法》《机关文件材料归档范围和文书档案保管期限规定》《机关档案管理规定》等三部法律法规提出了七处修改建议。The existing laws and regulations in China about the storage period,transfer period,closed period,confidentiality period of archives guide archives management,but there are also many contradictions and conflicts.Based on the new"Archives Law","Confidentiality Law","the Implementing Method of Archives Law","Government Information Public Rules"and other relevant laws and regulations,this paper sort out the current situation and discuss the classification of the core concepts such as the storage period,transfer period,receiving conditions,closed period,confidentiality period and government information disclosure period of the documents and archives,and find out three kinds of contradictions.In view of these contradictions,this paper raised seven recommended changes of the these laws and regulations,including"the Implementing Method of Archives Law","the Provisions on the Archiving Scope and the Storage Period of Documents and Archives",and"the Provisions on the Management of Archives".
