新《档案法》视域下公民档案权利和义务实现研究

摘　　要：新《档案法》对我国公民档案权利和义务等都做了明确规定,在保障公民档案权利实现和义务履行等方面有着诸多进步之处和重要意义。文章分析了公民档案权利和义务的概念及相互关系,梳理了新《档案法》中公民档案权利和义务的具体内容,总结了当前我国公民档案权利和义务的实现现状,从更好保障公民档案权利实现和促进公民档案义务履行角度,提出了若干推动新《档案法》深入贯彻落实的建议和对策,从实现公民档案权利与义务的视角,探讨推动新《档案法》全面贯彻实施的建议和对策,以期对新《档案法》的全面贯彻实施、《档案法实施办法》的修订完善等有所参考或指导。The new revised"Archives Law"has clearly stipulated the archival rights and obligations of Chinese citizens,which has made various kinds of progress and great significance in guaranteeing the realization of the rights and obligations of citizens in archives.This paper distinguished the concept of citizens'archival rights and obligations and their relationship,sorted out the specific contents of citizens'archival rights and obligations in the new revised"Archives Law",and summarized the current situation of the realization of citizens'archival rights and obligations in China.From the perspective of realizing the rights and obligations of citizens'archives,this paper discussed the suggestions and counter measures to promote full implementation of the new"Archives Law",in order to provide reference for carrying out the new revised Archives Law and perfecting the Measures for the Implementation of the Archives Law.
