体育赛事直播节目作品独创性认定标准论析——以“央视国际公司诉聚力公司案”为例

摘　　要：近年来,随着网络传播技术的普及应用,在体育赛事直播领域因不合理使用导致的侵权行为日益增多。体育赛事直播节目作品的独创性认定成为法学理论界和司法实践中的一个热点和难点问题。聚焦“认定标准是什么、其法理和法律依据是什么、体育产业各方主体的利益如何平衡”等一系列问题,采用文献资料等研究方法,以“央视国际公司诉聚力公司案”为例,就体育赛事直播节目独创性认定标准、认定需考量的相关因素进行系统探讨,并在此基础上提出评价建议。In recent years,with the popularization and application of network communication technology,infringement behaviors caused by unreasonable use in the field of live sports events are increasing day by day.The originality identification of live sports event program works has become a hot and difficult issue in the field of law theory and judicial practice.Focus on what is“standards,what is its legal theory and legal basis,how to balance the interests of the parties to the subject”sports industry and a series of problems,this paper use the research methods such as literature,to“CCTV international partners v cohesion”,for example,live sports events show originality identifying standard,need to take account of the system,this paper discusses the factors,On this basis,some evaluation suggestions are put forward.
