情境预防观下企业犯罪之防范对策研究

摘　　要：情境犯罪预防作为企业合规建设的重要内容值得关注。通过选取2492份裁判文书数据,揭示犯罪情境与实质性判决间的关联模式。研究结论表明,与企业犯罪密切相关的情境尚未成为司法机关考虑的主要因素,传统的犯罪手段与犯罪后状况仍是司法机关考虑的重点。为此,企业犯罪防范之建议应为:企业合规应组合运用增加犯罪阻力、增加犯罪风险、减少犯罪诱因、减少犯罪刺激、移除犯罪借口等五大行动对策;将合规遵循作为企业伦理文化的关键内容,配套"吹哨者"计划施行,并以监管疏失之责任为桥梁构建企业行政合规,从而阻断犯罪情境的各项诱因,减少犯罪机会。Situational crime prevention as an important part of corporate compliance construction is worthy of attention. By selecting 2,492 pieces of judgment documents, we hope to reveal the correlation pattern between the crime situation and the substantive judgment. The research conclusions show that the situation closely related to corporate crime has not yet become the main factor considered by the judiciary. Traditional criminal methods and the situation after the crime are still the focus of the judiciary’s consideration. To this end, the recommendations for corporate crime prevention should be: corporate compliance should use a combination of five major actions such as increasing crime resistance, elevating crime risks, reducing criminal inducement, reducing criminal incentives, and removing criminal excuses;companies should adopt compliance as a corporate ethical culture, incorporating the key content of the "Whistleblower" plan, and use the responsibility of regulatory negligence as a bridge to build corporate administrative compliance, so as to block various incentives for criminal behaviors and reduce criminal opportunities.
