后《国家情报法》时代的国家安全情报法律体系建设--以“法益”理论为视角

摘　　要：[目的/意义]迄今,《国家情报法》已经施行三年有余,鉴于“法律的生命在于实践”,因此,利用“法益”理论,可以重新对《国家情报法》中的相关内容进行评估,并为后《国家情报法》时代的国家安全情报法律体系建设提供行动方案。[方法/过程]以“法益变迁”为基本切入维度,可以识别出后《国家情报法》时代的国家安全情报法律体系建设可能面临的问题。[结果/结论]应以“一体多元”作为后《国家情报法》时代安全情报法律体系建构的基本原则;以“逻辑自洽”作为后《国家情报法》时代安全情报法律体系建构的实体路径;以“价值调适”作为后《国家情报法》时代安全情报法律体系建构的立法理念。[Purpose/Significance]So far,The National Intelligence Law has been implemented for more than three years.In view of the fact that"the life of law lies in practice",the theory of"legal interest"can be used to reevaluate the relevant contents of The National Intelligence Law,and provide an action plan for the construction of the national security intelligence legal system in the post national intelligence law era.[Method/Process]Based on the change of legal interests,we can identify the problems that may be faced by the construction of the legal system of national security intelligence in the post national intelligence law era.[Result/Conclusion]We should take"unity and diversity"as the basic principle of the construction of the legal system of security intelligence in the post national intelligence law era,"logical self-consistency"as the substantive path of the construction of the legal system of security intelligence in the post national intelligence law era,and"value adjustment"as the legislative idea of the construction of the legal system of security intelligence in the post national intelligence law era.
