澜湄流域网络犯罪治理的SWOT态势分析

摘　　要：随着互联网技术的快速发展,澜沧江—湄公河流域的安全问题日趋复杂多元,利用网络实施赌博、骗取民众钱财、助推毒品交易传播等网络犯罪不断滋生蔓延。通过引入SWOT战略分析法分析得出:澜湄国家共同打击网络犯罪具有澜湄执法中心平台优势与澜湄各国良好警务合作基础优势,及敏感复杂的政治环境与有限的网络犯罪治理能力劣势;面临良好的合作前景和全面深入的合作需求机遇,及法律适用冲突与管辖权冲突挑战。因此,完善澜湄流域网络犯罪治理应制定有针对性的推动流域网络安全执法合作的策略,如完善澜湄流域网络犯罪治理的法律基础,充分发挥澜湄执法中心的多边平台优势,建立澜湄网络安全观和网络犯罪合作治理机制。With the rapid development of Internet technology,the overall problems of the Lancang-Mekong River Basin have become increasingly complex and diverse.Cybercrimes such as using the Internet to gambling,defrauding people’s money,and facilitating the spread of drug transactions continue to spread.Through the introduction of the SWOT strategic analysis method,we know,it has the strengths of the Lancang-Mekong countries in jointly combating cybercrime are the platform advantages of the Lancang-Mekong law enforcement center and the good police cooperation basis of the Lancang-Mekong countries,and the weaknesses of sensitive and complex political environment and limited cybercrime governance capabilities;It faces good prospects for cooperation and opportunities for comprehensive and in-depth cooperation needs,as well as threats of conflict of law application and conflict of jurisdiction.So,we need to develop targeted strategies to promote law enforcement cooperation for network security in river basins:improve the legal basis for cybercrime governance in the Lancang-Mekong basin,give full play to the advantages of the Lancang-Mekong law enforcement center’s multilateral platform,and establish a Lan-Mekong cybersecurity concept and cybercrime cooperation Governance mechanism.
