摘　　要：目的:了解全球医药及医疗器械领域重点专利的分布,并对专利保护期延长制度进行分析与探讨,为我国医药科技创新和知识产权强国建设提供客观的数据依据和科学的理论支撑。方法:检索全球化学药、中药、生物药、医疗器械四大技术领域专利数据,从行业影响力、市场影响力、侵权风险等维度识别出各领域重点专利。结果:医药及医疗器械领域已积累大量高影响力专利,诉讼频发。结论:医药及医疗器械领域重点专利绝大多数来自美国,我国仍需持续提升质量;分类跟踪管理;建立风险专利管理平台,完善药品专利保护期限相关制度。Objective:To understand the global distribution of key patents in the field of medicine and medical devices,and to analyze and discuss the patent protection period extension system,so as to provide objective data and scientific theoretical support for our country's medical technology innovation and intellectual property power construction.Method:Search global patent data in the four major technical fields of chemical medicine,traditional Chinese medicine,biological medicine,and medical devices,and identify key patents in each field from the dimensions of industry influence,market influence,and infringement risk.Result:A large number of high-impact patents have been accumulated in the field of medicine and medical devices,and lawsuits have been frequent.Conclusion:The vast majority of key patents in the field of medicines and medical devices come from the United States,and China still needs to continuously improve quality,classified tracking management,establishing a risk patent management platform,and perfecting the relevant system of drug patent protection period.
