略论案例教学与大学生创业法律风险防范教育--以公司法学案例教学为例

摘　　要：大学生创业法律风险是大学生创业失败的重要因素,案例教学对大学生创业法律风险教育具有重要作用。在案例选择方面应当遵循时效性、真实性、目的性、贴近大学生生活等原则。大学生创业过程中的法律风险主要体现在企业组织类型选择、经营场所租赁、公司章程内容设计、经济合同签订、劳动用工等方面。应当对大学生创业法律风险的识别与防范能力进行培养,重点培养大学生的法律知识获取能力和法律风险系统防范能力。Legal risk is an important factor of failure on university students’entrepreneurship.Case teaching plays an important role in the legal risk education of college students’entrepreneurship.In case selection,we should follow the principles of timeliness,authenticity,purpose,and close to college students’life.The legal risks of university students in the process of starting a business are mainly reflected in the selection of enterprise organization type,house leasing of business,content design of company’s articles,signing of economic contracts,employment and so on.It is necessary to cultivate the ability of identifying and preventing the legal risks of starting a business,especially the ability of acquiring legal knowledge and the ability of preventing the legal risks.
