水污染物排放标准达标判定规则的行政法原则探析

摘　　要：达标判定是污染物排放限值标准的核心内容,也是水环境监督管理和企业合规评价的基础,达标判定规则的合法性对于标准的实施至关重要。本文梳理了水污染物排放标准判定规则的主要类型,以达标考核期为重点,分析了国内外水污染物排放标准达标判定规则的研究和实践,并且在此基础上,从行政法基本原则视角提出对达标判定规则的思考。Standards conformity assessment is the core content of limit value standard for pollutant,and also the basis of environmental supervision and management.The legality and fairness are of vital importance for the effective implementation of the standard.This paper describes the main types of assessment criteria and analyzes the domestic and foreign research and practice.Focusing on the assessment period of standards conformity from the perspective of the basic principles,this paper puts forward some thoughts on the criteria of the standards conformity assessment of water pollutant discharge.
