摘　　要：恶势力犯罪具有组织、行为和危害后果三个方面的特征,不需要具备“过渡性”特征;分为恶势力团伙犯罪和恶势力集团犯罪。目前,实务界对恶势力犯罪三特征中部分术语的认识仍有分歧,导致恶势力犯罪认定标准不一致、侦查取证难度大等问题。因此,需要释明恶势力犯罪立法中意思模糊的术语,确立恶势力犯罪的认定标准,提高实务部门办案人员的业务素质,完善证人保护制度,构建恶势力犯罪定罪处罚的标准化体系。Evil-force crimes have three characteristics:organization,behavior and harmful consequences,so it does not need to be“transitional”.Evil-Force crimes can be divided into evil-force gang crimes and evil-force group crimes.There are still some differences in the understanding of some terms in the three characteristics of crimes committed by evil forces,which lead to the problems of inconsistent standards and great difficulty in investigation and evidence collection in identifying evil-force crimes.In view of the above problems,the countermeasures are as follows:to clarify the ambiguous terms in the criminal legislation of evil forces,to establish the identification standard of the crime of evil forces,to improve the professional quality of the case handling personnel in practical departments,to improve the witness protection system,and to build a standardized system of conviction and punishment of evil-force crimes.
