摘　　要：作为金融市场新型主体,金融科技公司直接或间接参与金融市场过程中存在着信用风险、系统性风险、信息安全风险和监管套利风险等各类风险,需要予以有效监管。当前我国金融科技公司的监管体系由一行两会主导的业务监管和网信办、工信部主导的技术监管构成,但监管漏洞和监管重叠的问题比较突出。为促进和规范金融科技公司的发展,需要完善业务与技术相协调的监管体系,明确包容监管、原则监管和风险底线等监管原则,从市场准入、业务规范、风险控制和内部治理等层面建立监管规范,创新技术监管、穿透监管和合作监管等方法,尽快制定《金融科技公司监督管理办法》、建立兼顾创新与风控的监管制度以及业务监管与技术监管之间的协调机制。As a new type of financial market entity,there are various risks such as credit risk,systemic risk,information security risk,and regulatory arbitrage risk in the process of direct or indirect participation of fintech companies in the financial market,which requires effective supervision.At present,the supervision system of Chinese financial technology companies is composed of business supervision led by financial regulators and technology supervision led by Cyberspace Administration of China and Ministry of Industry and Information Technology of China,but the problems of supervision loopholes and overlap are more prominent.In order to promote and regulate the development of fintech companies,it is necessary to improve the regulatory system in which business and technology are coordinated,clarify regulatory principles such as inclusive regulation,principled regulation and risk bottom line,and establish rules from the aspects of market access,business regulation,risk control and internal governance,and explore technology supervision,penetration supervision and cooperation supervision and other methods,formulate the“financial technology company supervision and management measures”,formulate a supervision system that takes into account innovation and risk control,and a coordination mechanism between business supervision and technical supervision.
