摘　　要：排污许可管理制度建立的基本价值诉求是实现环境保护的公平正义,体现“环境保护与经济发展相协调”与“污染者担责”的环境法治原则。我国在《生态文明体制改革总体方案》中已经明确了排污许可制度在环境治理法律体系中的核心地位。排污许可管理制度在环境治理体系中侧重于过程治理阶段,从全周期治理结构的连续性上与其他环境管理制度协同性较差。我国排污许可管理制度不仅应当从环境质量管理、流域区域纳污监管规则等方面着手,而且应当有效地解决现有环境法规范的结构性问题,实现《排污许可管理条例》与其他环境法律规范相互协同,进而夯实《排污许可管理条例》在环境治理法律体系中的地位,实现环境法律规范共治的规制效果。The basic value of the discharge permit system is to achieve fairness and justice in environmental protection,and to reflect the logic of“harmonizing environmental protection with economic development”and“polluters’accountability”in environmental rule of law.In the General Plan for the Reform of Ecological Civilization System,China has clearly defined the core position of the emission permit system in the legal system of environmental governance.In the environmental governance system,the emission permit management system focuses on the process governance stage and is less synergistic with other environmental management systems in terms of the continuity of the full-cycle governance structure.China’s emission permit management system should not only start from environmental quality management,basin area pollution control rules,etc.,but also effectively solve the structural problems of existing environmental law norms,realize the mutual synergy between the Regulations on Emission Permit Management and other environmental legal norms,make the emission permit management system as a responsive environmental law norms to reinstitute the environmental governance structure integrity,and then consolidate the Emission Permit The Emission Permit Management Regulations,which may strengthen the status of the Emission Permit Management Regulations in the legal system of environmental governance,and achieve the mutual governance effect of environmental rule of law and regulations.
