摘　　要：优先登机规则在航班超售时,可能直接用于拒载旅客,关乎旅客权益。由于航空相关法律未有优先登机规则,由航空公司自行制定的优先登机规则,存在通知不当及部分内容有失公平的问题。实践中,优先登机规则大致分为“先到先得”和“综合衡量”两类规则。优先登机规则在航班超售拒载中的适用需借鉴域外经验,填补法律层面的基础理论空白,在规章中细化规定其具体内容及通知义务。Related to passengers’rights and interests,the priority boarding rule may be used directly to deny boarding to passengers when a flight is oversold.Not adjusted by special laws,this rule is made by airlines themselves,and thus,there are some problems such as improper notice and unfair content.In practice,priority boarding rules are roughly divided into“first come,first served”and“comprehensive measurement”rules.The application of priority boarding rules in flight overbooking and rejection should draw lessons from foreign experience to bridge the basic theoretical gaps at the legal level,and specify its specific contents and notification obligations in the regulations.
