摘  要:租赁型担保作为一种非典型担保方式,其效力基本上不被司法实践所认可。文章通过梳理相关司法案例,认为租赁型担保有其市场基础,否定其效力的法律依据不足。文章建议重塑租赁型担保的合理规则,在区分租赁型担保类型的基础上,对明示型租赁担保,应当对租赁权进行登记公示才能具备对抗功能;对隐藏型租赁担保,通过限制“一次性租金支付”年限,间接限制租赁权的对抗效力,防止债务人利用租赁型担保逃避债务、规避执行,平衡债权人、债务人和第三人的利益。As an atypical guarantee,the effectiveness of leasehold guarantee is not generally accepted by judi⁃cial practice.By reviewing the relevant judicial cases,it is concluded that the leasehold guarantee has its market ba⁃sis and the legal basis for denying its validity is insufficient.It is necessary to reshape the reasonable rules of the lease type guarantee.On the basis of distinguishing the types of lease guarantee,as for the explicit lease guarantee,it needs to register and publicize the lease right in order to have the antagonism function;in the case of the hidden lease guarantee,the effectiveness of the lease right is indirectly limited by limiting the number of years for which the“one-time rent payment”is made.To prevent the use of lease guarantee to evade debt,avoid execution,the interests of creditors,debtors and third parties should be balanced.
