摘　　要：清末民初的法政变革中,由清末修律至预备立宪再至辛亥起事,传统中国法制以加速度的方式迅速被现代法政体制整体性的取代。作为最后一部中国传统法典的《钦定大清现行刑律》,在清末虽未能实现"过渡之用",却在北洋时期开出了"《现行律》民事有效部分"之果。其间虽有北洋时期政权动荡的因素,更是临时参议员与民初大理院的推事们主动选择的结果。这一看似保守的选择,有效地避免了因民事法律的全盘继受可能带来的社会生活自身的动荡,使得传统中国社会的人伦底蕴得以部分留存,也使得新式司法体制本身更易为尚未完成转型的传统社会所接纳。待得社会本身日益演化,新法的实施也就水到渠成了。"《现行律》民事有效部分"实为近代法律史上于变革社会中赓续传统法制最重要的范本。During the legal reform of the late Qing and early Republic of China, several symbolic events including the legal revision in late Qing, the preparation for the constitutionalism and the Xinhai Revolution, which refers to the fact that the traditional Chinese legal system was replaced by the modern counterpart in an accelerated manner. As the last Chinese traditional code of law, although the Current Criminal Law of the Qing Dynasty failed to achieve its "transitional purpose", it did contribute to the Effective Civil Law in the Current Criminal Law during the Beijing government period. Although there are turbulence of the regime during the Beijing government period, it was the result of a choice made by the provisional senators and the judges of dali court in the early Republic of China. This seemingly conservative choice has effectively avoided the social unrest that might have been brought about by the systematical change of civil law, maintained some traditional ethnic rules, and made the new judicial system more compatible to a traditional society without completing its transition. Within the evolution of society, the implementation of the new law became a natural outcome. The Effective Civil Law in the Current Criminal Law could be seen as the most important model in modern legal history for the continuation of the traditional legal system in a dynamic society.
