摘  要:非诉讼解决机制是多元化纠纷解决机制重要举措,劳动争议非诉讼解决机制是劳动争议当事人通过非法院诉讼程序解决争议的综合性调整机制,包括劳动仲裁、人民调解以及劳动协商等方式。但目前我国劳动争议非诉讼解决机制存在立法供给不足、运行成本高、功能发挥有限、执行绩效不高等诸多障碍,致使该机制在运行中发挥效益有限。因此,该文从法经济学效益最大化角度分析了劳动争议非诉讼解决机制的成本和收益,论证了该机制运行效益最大化的价值所在,并提出了实现该机制运行效益最大化的改革方向。Non-litigation settlement mechanism is an important measure of diversified dispute resolution mechanism,and non-litigation settlement mechanism is one of the important ways to resolve labor disputes with the characteristics of low cost,simple flexibility and high efficiency.However,at present,China’s labor dispute non-litigation settlement mechanism has many obstacles such as insufficient legislative supply,high operating cost,limited function,low implementation performance,resulting in the effectiveness of this mechanism in operation is unsatisfactory.Therefore,this paper,from the perspective of maximum benefit of legal economics,analyzes the costs and benefits of labor dispute non-litigation settlement mechanism,demonstrates the value of the mechanism’s operating efficiency,and puts forward the reform direction to maximize the operating efficiency of the mechanism.
