关于本国优先权初步审查制度的思考

摘　　要：在本国优先权的初步审查中,笔者发现很多申请人为了满足审查指南中规定的本国优先权成立的条件,会采用撤回在先申请享有的优先权的方式。如果实际属于部分优先权的情形,采用撤回优先权的方式会损害申请人的利益。本文对现有本国优先权初步审查制度进行深入分析,排查其中可能存在的风险点,并在最后提出了一种较为合理的审查处理方式,希望能对此类问题的解决提供参考。In the preliminary examination of the domestic priority set,it is found that many applicants will withdraw the priority of the previous application in order to meet the conditions of the domestic priority set forth in the examination guide.If it is part of the priority,the withdrawal of priority will damage the interests of the applicant.This paper makes an in-depth analysis of the existing domestic priority preliminary review system,investigates the possible risk points.Finally,this paper puts forward a more reasonable way of review,hoping to provide a reference for solving such problems.
