摘  要:经过数百年的发展完善,牛津大学以章程为基础,建构起一套精致细微、行之有效、独具特色的教师学术权利保障体系。在现行牛津大学章程中,不仅有广泛具体的学术权利规范,延续学者治校、民主决策和学院制传统的治理架构,而且有充分体现参与性与公开性、平等性与中立性、合理性与时效性的程序保障,以及以投诉、申诉和上诉为主要渠道的救济机制,对我国大学章程完善教师学术权利保障具有重要的学习借鉴价值。我国大学章程应进一步凸显权利保障书的特质,加强教师学术权利保障的规章制度建设,优化治理结构,强化程序保障,健全救济机制。With the development and perfection of several hundred years,Oxford University has had the exquisite,effective and characteristic guarantee system of teachers’academic rights based on the Statutes and Regulations.The current Oxford University Statutes and Regulations has not only the extensive and specific academic rights norms,and the governance framework which continues the tradition of scholar governance,democratic decision and college system,but also the procedural guarantee which adequately embodies the character of participation and openness,equality and neutrality,rationality and timeliness,as well as the relief mechanism which includes the ways of complaint,petition and appeal,which shows the important referential value to perfect teachers’academic rights guarantee system of our university charter.We should highlight the peculiarity of right guarantee in our university charter,reinforce the construction of teacher’s academic rights rules,optimize the governance strurcture,intensify procedural guarantee,and perfect the relief mechanism.
