Certain Iranian Assets: The Judgment on Preliminary Objections and the Terrorism Exception to State Immunity

摘  要:The legality under international law of the terrorism exception to state immunity is a long-standing and highly controversial issue.The International Court of Justice(ICJ or the Court)had the chance to answer this question in the Certain Iranian Assets case,but the Court decided in its Judgment on Preliminary Objections that the legality of the U.S.terrorism exception is outside the Court’s jurisdiction,and the Court’s judgment was criticized as Solomonic.This paper tackles this issue in two parts:The first part reviews the ICJ’s Judgment and shows that the said Solomonic approach was not adopted and the Court is right in deciding that the disputes concerning state immunity are outside the Court’s jurisdiction.The second part assesses the legality under international law of the terrorism exception.Taking consideration of the jurisdiction principle,the restrictive theory of the state immunity,and the law of state responsibility,this paper concludes that the terrorism exception is not compatible with the current rules of international law in the above-mentioned fields.
