摘　　要：经济法是以社会整体经济利益为价值目标,以国家干预为规范构成的一类规范集合。由于经济单行法规范的复合性,经济法法典化无法实现总则与分则的逻辑涵摄。制定一部沟通宪法与单行法的经济法总则或者总则性的经济基本法,是回应目前法典化之不能与立法统合现实需要之间矛盾的实用主义路径。在此基础上,经济基本法的制定应明确其统摄单行法的制度定位,寻找总则模式立法的国内外体系坐标,明确其将经济权力主导的经济关系作为调整对象,提炼价值元层面的社会整体经济利益原则和价值次级层面的实质公平和公平竞争原则,规范层面的国家干预原则所派生的国家干预适当性原则、国家干预合法性原则以及国家干预效率原则,并以"主体——客体——责任"为基本框架,构建纯粹的经济法规范体系。Economic law is a set of norms composed of the overall economic interests of society as the value goal and state intervention as the norm.Due to the complex nature of the norms of separate economic laws,the codification of economic law cannot achieve the logical connotation of general and sub-rules.To formulate a general economic law or general economic basic law that communicates the constitution and separate laws is a pragmatic way to respond to the contradiction between the current codification and the need for legislation to unify reality.On this basis,the formulation of the Basic Economic Law should clarify its institutional positioning that governs the individual law,look for the domestic and foreign system coordinates of the general rule model legislation,clarify that it takes economic relations dominated by economic power as the adjustment object,and refine the overall social economy at the value element level.The principle of interest of society and the principle of substantive fairness and fair competition at the sub-level of value,the principle of appropriateness of state intervention,the principle of legitimacy of state intervention,and the principle of state intervention efficiency derived from the state intervention principle at the normative level with the"subject-object-responsibility"as the basic framework construct a purely economic law norm system.
