作品“宽容使用”引发的问题及其解决路径

摘　　要：作品"宽容使用"会引发"版权蟑螂"、著作权"弃法者"、著作权"利益待定"等问题。我国应当在著作权制度中构建"许可声明"制度和"默示许可"制度,减少作品"宽容使用"的情况,以保护著作权人和社会公众的合法权益,对于维护著作权制度的权威性和稳定性也有着重要意义。With the rapid development of communication technology,there are more and more"tolerant use"of works.The"tolerant use"of works will lead to the"copyright cockroach",the"abandoner"of copyright,and the"undetermined interests"of copyright.We should build"license declaration"system and"implied license"system in the copyright system to reduce the situation of"tolerant use"of works,which can not only protect the legitimate rights and interests of copyright owners and the public,but also have important significance for maintaining the authority and stability of the copyright system.
