论功能视角下规范性文件备案审查标准体系的完善

摘　　要：规范性文件备案审查标准体系是规范性文件备案审查制度的核心部件和关键元素。然而,法律与法律、法律与实践、国家机关与国家机关之间关于规范性文件备案审查标准的规定并不统一,个别甚至存在矛盾与冲突,从而严重影响规范性文件备案审查功能的正常发挥。规范性文件备案审查具有维护法制统一、保证中央令行禁止、保障人民权益和提高规范性文件质量四大制度功能。从实现制度功能需求出发,合法性、合宪性、政治性和合理性应当成为规范性文件备案审查的四大审查标准。这四大标准既各具独自丰富的内容,又相辅相成、缺一不可,共同构成了一个统一、科学、完整、可操作的规范性文件备案审查标准体系。The standard system of normative document filing and review is the core component and key element of the normative document filing and review system. However, the provisions on the standard of filing and examination of normative documents between law and law, law and practice, and between state organs and state organs are not unified, and there are even contradictions and conflicts in some cases, thus seriously affecting the normal exertion of the filing and examination function of normative documents. The filing and review of normative documents has four major system functions: maintaining the unity of the legal system, ensuring the prohibition of central decrees, protecting the rights and interests of the people and improving the quality of normative documents. In order to realize the functional requirements of the system, legitimacy, constitutionality, political nature and rationality should be the four major review standards for the filing and review of normative documents. These four standards not only have their own rich content, but also complement each other and are indispensable, which together constitute a unified, scientific, complete and operable standard system for the filing and review of normative documents.
