摘　　要：Traditional Chinese medicine knowledge has both cultural and commercial value,and is related to national industrial security and cultural security.Under the guidance of the legal protection for the security of intellectual property rights,we shall examine the dilemma of the TCM knowledge in China from the two dimensions of industrial security and cultural security,reflect on the causes of the dilemma,and learn from the legal protection model for the safety of traditional medical intellectual property rights of foreign countries,to prevent and resolve various intellectual property security risks that affect the development of TCM knowledge in China.We shall integrate various intellectual property systems,coordinate and promote the construction of intellectual property system from six aspects,which are TCM industry competition security,industrial innovation security,and industrial brand security,as well as TCM cultural security system,cultural security environment,and cultural inheritance security,construct a legal protection system for the security of TCM intellectual property rights with Chinese characteristics,and enhance the legal protection and governance of intellectual property rights of TCM knowledge.中医药传统知识兼具文化价值和商业价值,且事关国家产业安全和文化安全。在知识产权安全法治保障引领下,从产业安全和文化安全两个维度审视我国中医药传统知识面临的安全法治保障困境,反思其困境之成因,借鉴域外国家传统医药知识产权安全法治保障模式,期以防范和化解影响我国中医药传统知识发展的各种知识产权安全风险。整合各项知识产权制度,统筹推进中医药产业竞争安全、产业创新安全和产业品牌安全,以及中医药文化安全体系、文化安全环境和文化传承安全六个层面的知识产权制度建设,建构具有中国特色的中医药传统知识知识产权安全法治保障体系,提升中医药传统知识知识产权安全法治保障和治理水平。
