摘  要:在现有法律框架下,灵活从业人员组建工会面临着成员主体资格、工会职能内容、组织定位与性质等法律问题。通过梳理和释明法律规制要旨及立法目的,组建灵活从业人员工会在理论逻辑上有章可循。在集体劳动权理论框架下,工会成员范围可扩展至灵活从业人员;在维护劳动者合法权益目的下,对工会的合理性赋权可解决工会职能和集体合同主体的问题;结合灵活从业人员职业特点和工会法律地位应用空间,组织结构应定位于地方的产业工会。在具体实践进路方面,灵活从业人员可通过网络平台、工会窗口、社区工会、企业工会等途径加入工会组织,依靠工会组织就劳动条件和算法规则事项进行集体协商,以维护正当权益。Under the current legal framework,flexible practitioners are facing some legal problems in establishing labor unions,including the qualification of members,the scope of labor union functions,the orientation and nature of labor union organization.Through sorting out and interpreting the essence of legal regulation and the purpose of legislation,the theoretical logic of flexible practitioners‘union has rules to follow.Applying the explanatory power of collective labor right theory,the scope of labor union membership can be extended to flexible practitioners;Considering the purpose of safeguarding the rights and interests of workers,the reasonable empowerment of labor unions can solve the problems of labor unions’functions and collective contract objects.Combining with the characteristics of flexible practitioners and the application space of the legal status about the labor union,the organizational structure should be positioned at the local industrial labor union.In terms of practical approaches,flexible practitioners can join the labor unions through network platforms,service windows,communities,enterprises.In order to safeguard legitimate rights and interests,their rely on labor unions to carry out collective negotiations which included working conditions and algorithmic rules.
