试论野生动物资源保护的检察监督

摘　　要：对野生动物资源的破坏与掠夺在触犯法律的同时也危及到社会公共利益和国家利益。野生动物资源保护的检察监督是检察机关对破坏野生动物资源违法犯罪制裁过程的监督,主要包括对破坏野生动物资源违法犯罪人的监督、相关行政主管部门执法活动的监督以及对公安机关、审判机关关于破坏野生动物资源犯罪刑事诉讼活动的监督。近年来,面对日益严峻的野生动物资源保护形势,检察机关充分发挥刑事检察、公益诉讼及行政检察职能,积极开展野生动物资源保护监督工作,面对检察监督中所存在的检察监督能力不足、监督手段刚性不够以及对行刑衔接监督力度有限等现实问题,可以通过积极履行检察监督职能、不断提升检察监督能力水平、提高检察监督刚性和强化行刑衔接工作监督力度等措施加以解决。The destruction and plunder of wildlife resources not only violates the law,but also endangers the public interests and national interests.The procuratorial supervision of wildlife resources protection is the supervision of the prosecution organization on the sanctions process of crimes of destroying wildlife resources,including the supervision over the offenders who violate the law,the supervision over the law enforcement activities of the relevant administrative departments,and the supervision over criminal proceedings of crimes against wildlife resources carried out by public security organization and judicial organization.In recent years,facing the increasingly severe situation of wildlife resources protection,the procuratorial organization makes full use of functions of criminal prosecution,public interest litigation and administrative prosecution,to actively carry out the supervision of wildlife resources protection,facing the practical problems existing in the procuratorial supervision,such as the insufficient procuratorial supervision ability,the insufficient rigidity of supervision means,and the limited supervision on the connection between administrative law enforcement and criminal justice,it can be solved by actively performing the procuratorial supervision function,continuously improving the level of procuratorial supervision ability,improving the rigidity of procuratorial supervision,and strengthening the supervision on the connection between administrative law enforcement and criminal justice.
