摘　　要：在全面推进依法治国的时代背景下,信访法治化建设具有现实的必要性。信访制度是保障信访权得以实现的基本制度,也是行政诉讼制度、行政复议制度之外保障权利救济的一种补充救济制度。本文主张以基本法律的形式引导信访活动的法治化进程,从根本上解决信访法律规范适用的法律依据问题。建议从以下四个方面完善信访法律规范:一是制定“信访法”,提升信访法律规范位阶;二是完善信访法律解释,维护信访法律规范权威;三是制定党内信访条例,厘清信访法律规范的适用;四是构建和完善信访法律体系。Under the background of comprehensively promoting the rule of law,the construction of the rule of law in public complaints and proposals is of practical necessity.The Public Complaints and Proposals System is the basic system to guarantee the realization of the public complaints and proposals right,and it is also a supplementary relief system to safeguard the right beside the administrative litigation system and administrative reconsideration system.This paper proposes to guide the legalization process of public complaints and proposals activities in the form of basic laws and fundamentally solve the problem of the legal basis for the application of legal norms for public complaints and proposals.The following four aspects are suggested to improve the legal norms of public complaints and proposals:First,formulate the Law on Public Complaints and Proposals to enhance the level of legal norms of public complaints and proposals;Second,to improve the legal interpretation and maintain the authority of the legal norms of public complaints and proposals;Third,formulate the regulations on public complaints and proposals within the Party to clarify the application of its legal norms;Fourth,to build and improve the legal system of public complaints and proposals.
