基于公私合作治理视角的科技计划项目合同法律适用问题研究

摘　　要：本文从理论、规范及司法三个层面梳理科技计划项目合同的相关文献、资料及现行管理办法,发现将科技计划项目合同单一归为行政或民事合同均存在不足。基于此,首先应引入公私合作治理的思考视角,打破传统理念带来的局限;其次运用“合作治理”的规范模型来重新认识科技计划项目合同概念,同时引入德国双阶理论来根据不同环节之特点来确定其属性以及所要适用的规范;最后基于当前最新的司法解释,判断科技计划项目合同属性为行政协议,且纳入到行政诉讼的救济模式,以讨论在该模式下运用民事法律规则的可行性,并依据双阶理论和优益权因素划分法修正适用德国双阶理论。This paper sorts out the relevant documents,materials and current management methods of the scientific and technological plan project contract from the three levels of theory,norms and justice,and finds that there are shortcomings in the single classification of the scientific and technological plan project contract as an administrative or civil contract.Based on this,the study found that firstly,we should introduce the perspective of public-private partnership governance to break the limitations brought about by the traditional concept;secondly,we should use the normative model of"cooperative governance"to re-understand the concept of science and technology planning project contract.At the same time,the German two level theory is introduced to determine its attributes and the applicable norms according to the characteristics of different links.Finally,based on the latest judicial interpretation,it is judged that the contract attribute of science and technology planning projects is an administrative agreement,and it is included in the relief mode of administrative litigation.At the same time,the feasibility of using civil legal rules under this model is discussed,and the German two level theory is modified according to the two level theory and the division method of advantages and interests factors.
