摘 要:目前,黄河流域生态环境恶化情况较为严重,需要通过立法对流域内的生态环境进行保护。立法时应采取中央立法和地方立法并重的综合模式。在坚持经济、社会和生态环境协调发展,政府、市场、公众共同参与,依靠科学技术保护生态环境,流域管理四项原则的基础上,由全国人大常委会和国务院分别制定《黄河法》及其实施细则,各省(自治区)制定和完善关于水、土地等资源开发利用、生态环境污染防治,以及黄河流域生态环境补偿机制方面的地方性法规。At present,the deterioration of the ecological environment in the Yellow River Basin is serious,so it is urgent to protect the ecological environment by legislation.The central legislation and the local legislation should be adopted in the legislation.On the basis of adhering to the four principles of coordinated development of the economy,society and the ecological environment,joint participation of the government,the market and the public,relying on science and technology to protect the ecological environment and river basin management,the Yellow River Law and its detailed rules for implementation shall be formulated by the Standing Committee of the National People’s Congress and the State Council respectively,and all localities shall formulate and improve regulations on the development and utilization of water,land and other resources,and the prevention of ecological and environmental pollution,and the ecological and environmental compensation mechanisms of the local ordinance.
