摘　　要：本文聚焦于中共中央、国务院最近印发的《乡村振兴战略规划》,既指出其令人振奋的一面,也指出一些其所忽视的问题,从既是历史回顾也是前瞻愿想的角度来提出一些建设性的思考。文章对比中国与西方(特别是美国的乡村)间相关的经济、社会和法律历史的异同,特别突出中国乡村小农、社区、产权体系与合作传统在过去和现在的作用。据此,提出一些仍然被忽视的关于全球经济和法律的看法。最后,进入关于双方现今和未来趋向的论析和愿想的讨论。This article focusses on the recent"StrategicPlan for Reinvigorating Rural China"issued by the Party Central cum the State Council of China,pointing out both its exciting aspects and also some overlooked issues,from both a retrospective historical perspective and a prospective view of visions,to offer some constructive considerations.The article compares rural China with the rural West,especially the United States,and their related economic,social,and legal historical differences and similarities,highlighting especially the role of small peasant farms,of rural communities,of differential property rights and common rules,and of cooperation in China.On that basis,the article makes some suggestions about globalized economic and legal issues,ending with a discussion of the recent and prospective future directions of the two countries.
