中日韩FTA战略比较与高水平合作前景:基于规则文本深度和质量的研究

摘　　要：在西方民族主义兴起、国际贸易保护主义抬头的背景下,中日韩自贸区建设有利于实现东亚区域一体化,但三国在多个敏感领域和规则标准上的分歧使得谈判进展缓慢。文章对比分析了中日韩三国FTA战略的异同,针对分歧较大的议题展开分析,并构建了多个衡量FTA协定深度的指标,实证检验并模拟了全面、高水平FTA的达成对三国及区域贸易的影响。研究发现,中日韩各自的FTA战略在伙伴选择、规则标准和内容覆盖率等方面存在较大差异,三国在关税减让、农业、数字贸易、知识产权、竞争政策、劳工和环境等具体议题上亦分歧较大。高水平FTA对贸易有着显著促进作用,区域整体及各国都将从中获益,且具有法律可执行性的条款更能发挥贸易促进效应。不同巨型区域贸易协定的模拟结果显示,RCEP是否包含印度、美国是否重返CPTPP都影响不大,而高水平中日韩FTA能给区域整体和三国带来更大的贸易效应。中国应将中日韩FTA视为构建高水平FTA网络的可行路径,努力推动中日韩FTA取得突破性进展。Against the backdrop of the rise of Western nationalism and trade protectionism,the construction of the China-Japan-Korea Free Trade Area is conducive to regional integration in East Asia.However,the differences between the three countries in multiple sensitive areas and the standards of the rules have slowed the progress of negotiations.This paper compares and analyzes the similarities and differences between the FTA strategies of China,Japan,and South Korea,analyzes the issues with greater divergence,and constructs multiple indicators to measure the depth of the agreement,then empirically tests and simulates the trade effect of FTA with different depths.The conclusion shows that the FTA strategies of China,Japan,and South Korea differ greatly in terms of partner selection,standards of rules,and content coverage,the three countries have great differences on specific issues such as tariff reduction,agriculture,digital trade,intellectual property rights,competition policy,labor,and environment.High-level FTA has a significant role in promoting trade and legally enforceable rules can better play the role of trade promotion.The simulation results of different mega-regional trade agreements show that whether RCEP includes India and whether the United States returns to CPTPP has little effect,and high-level CJK FTA can bring greater trade effects to the entire region and the three countries.China should regard the CJK FTA as a viable path to build a high-level FTA network,and strive to make breakthroughs in it.
