摘　　要：在环境司法审判中,以金钱赔偿方式达到生态环境功能恢复目标的做法并不少见。《民法典》对生态环境侵权金钱赔偿予以体系化规制,已经建构起以损害填补、获利剥夺、行为惩戒为基本范畴的递进式功能框架。在此基础上,对金钱赔偿的数额裁量,一是通过公共利益与私人利益在实体层面和程序层面的识别,厘清不同类型诉讼中金钱赔偿的具体范围,进而通过法律适用要件分析和赔偿范围间的逻辑演绎,确定个案中的赔偿类型;二是通过科学认定方法的匹配对金钱赔偿予以量化。In environmental justice, it is not uncommon to achieve the goal of ecological environment function restoration by means of monetary compensation.The Civil Code systematically regulates the monetary compensation for ecological environment infringement, and has constructed a progressive functional framework with the basic categories of filling damage, depriving of profit and disciplining bad behavior. On this basis, the discretion of the amount of monetary compensation is to clarify the specific scope of monetary compensation in different types of litigation through the identification of public interests and private interests at the substantive and procedural levels;then, through the analysis of the elements of law application and the logical deduction between the scope of compensation, the category of compensation in the case is determined. The second is to quantify the monetary compensation by matching the scientific determination method.
