城乡融合发展取向的宅基地产权制度改革研究

摘　　要：我国“空心村”问题日趋严重,现有的“三权分置”改革的目的是盘活宅基地,但尚无法实现城乡要素的平等交换,尤其是无法满足新时期城乡融合发展对城市建设用地的客观需要。因此,应以城乡融合发展为目标继续深化宅基地产权制度改革:通过完善相关法律制度,赋予农民宅基地流转的权利;建立宅基地退出补偿基金,并赋予宅基地人格财产溢价,以激励进城农民自愿退出宅基地,融入城市。退出的宅基地转换为集体经营性建设用地直接或间接入市,在实现城乡要素平等交换的同时,满足城市建设用地需求,促进城乡融合发展。The problem of hollowed village is becoming more and more serious in China.From the perspective of spatial form,hollowed village reflects the problem of idle homestead.The fundamental reason is that the economic value of homestead cannot be realized under the existing institutional arrangements,and that farmers prefer to idle homestead rather than waive from it.In order to revitalize the homestead,the State implements the“tripartite entitlement system”.But the existing reform measures of“tripartite entitlement system”cannot achieve the equal exchange of urban and rural elements,and especially cannot meet the objective needs of urban construction land in the new era of urban-rural integration development.Therefore,we should continue to deepen the reform of homestead ownership system with the goal of urban-rural integration development.Namely,improve the relevant legal system and give farmers the right of free circulation of homestead;establish homestead exit compensation fund and give homestead premium of personality property in order to encourage farmers to waive from the homestead voluntarily and integrate into the city.The waived rural residential land is converted into collective construction land and enters the market directly or indirectly to meet the demand of urban construction land,so as to realize the equal exchange of urban and rural elements.
