摘　　要：新冠肺炎疫情对整个国家、社会是一场前所未有的考验,对人类健康和全球公共卫生安全是一次史无前例的挑战。反思此次疫情应对,法治问题是一个很突出的问题,依法治疫、科学治疫被屡屡提及。文章就新冠病毒疫情防控中我国现行《传染病防治法》暴露出的缺陷和不足进行深入思考,兼评《中华人民共和国传染病防治法》(修订草案征求意见稿)并提出完善建议,以推动我国《传染病防治法》的修订,完善公共卫生法律制度,在抗疫大战大考中提升突发公共卫生法治应对能力。The novel Corona Virus Disease 2019(COVID-19)was an unprecedented test for our country and the whole society.and it was also a challenge to human health and global public health security.Reflection on the response to the COVID-19,preventing and controlling in accordance with the law and the science is often mentioned,which is a prominent issue.The paper takes the shortcomings and deficiencies of Infectious Disease Prevention Act in the prevention and control of COVID-19 into deep consideration,makes comment on the revised draft for comment of Infectious Disease Prevention Act released in 2020,and then proposes legislative modification suggestion to promote the modification of Infectious Disease Prevention Act,improve public health legislation and response capacity of public health emergency management in the severe test of prevention and control of epidemic case.
