利益平衡视角下数字时代图书馆使用作品版权例外制度的价值考量

摘　　要：随着数字技术的革新,以及图书馆的现代化转型与变革,现有的图书馆使用作品版权例外制度已无法满足图书馆对于作品现代化管理与利用的需求。一方面,数字环境下私人权利不断扩张,而文化遗产的现代化利用需求越来越大;另一方面,数字技术加持下私人对知识的控制越来越强,同时公众对于文化知识的获取诉求也愈加热烈。因此,针对数字时代图书馆功能的新发展,有必要重新对图书馆使用作品版权例外制度进行价值考量,在确立公益价值优位性的基础上,明确对私益价值尊重和保护的必要性。With the innovation of digital technology,and the modernized transformation and reform of library,the existing library copyright exception system cannot meet the need of library in its modernized management and utilization of works.On the one hand,private rights continuously expand in the digital environment,while the demand for modern use of cultural heritage is getting higher;On the other hand,with the help of digital technology,private control over knowledge is becoming stronger,while the public’s demand for acquiring cultural knowledge is more enthusiastic.Therefore,in view of the new development of library function in the digital era,it is necessary to re-evaluate the value of library copyright exception system,and on the basis of establishing the superiority of public value,clarify the necessity of respecting and protecting the value of private interest.
