摘 要:《气象法》规定气象主管机构所属的气象台作为气象预警主体,成效卓著;《传染病防治法》则规定政府或卫生行政部门作为疫情预警主体,对主体进行严格限制。政府或卫生行政部门作为疫情预警主体,弊端很多;而疾控机构作为疫情预警主体,则好处很多。建议新成立的疾控主管机构尽快独立,并在其属下组建疫情监测中心;并参照《气象法》,修订《传染病防治法》,明确规定该中心为疫情预警主体。The Meteorological Law stipulates that meteorological stations under the competent meteorological departments are the subjects of meteorological early warning,which has achieved remarkable results.The Law on the Prevention and Treatment of Infectious Diseases stipulates that the government or the health administration department should be the subject of pandemic early warning and strictly restrict it.As the subject of pandemic early warning,the government or health administration department has many disadvantages while the CDC has many advantages.It is suggested that the newly established CDC become independent as soon as possible and that a surveillance center be set up under it.In reference to the Meteorological Law,the Law on the Prevention and Treatment of Infectious Diseases should be revised to explicitly stipulate that the center is the subject of pandemic early warning.
