摘 要:在《民法典》的监护制度体系中,监护人的范畴还包括被监护人近亲属之外其他愿意担任监护人的个人或组织,然而现行立法关于知情同意权行使主体的规定却较为混乱,如医疗决策时适用的知情同意制度,仅以患者和近亲属为核心构建,缺少非近亲属监护人行使知情同意权的明确规定,致非近亲属监护人行使知情同意权存在障碍。故当以司法解释或指导性案例的形式对《民法典》相关制度予以优化,明确监护人之知情同意权主体的规定,并加强医疗机构对之的监督职责,以保障作为患者的被监护人的利益。In the guardianship system of Civil Code,the category of guardianship is not limited to the guardianship's close relatives,but also includes other individuals or organizations willing to act as guardians.However,the current legislation on the exercise of informed consent subject is confused,e.g:informed consent system applicable to medical decision-making is only constructed with patients and close relatives as the core,it lacks explicit provisions for non-close-relative guardians to exercise the right of informed consent,which results in obstacles for non-close relatives to exercise informed consent.Therefore,the relevant system of Civil Code should be optimized in the form of judicial interpretation or guiding cases,and it should be clarified that guardians have the right to informed consent,and supervision duties of medical institutions should be strengthened to protect the interests of patients under guardianship.
