摘　　要：生态环境没有替代品,用之不觉,失之难复。法律生态化融合生态学思维、法律思维与生态文明理念,是解决环境问题的一剂良方。以法律生态化为理论起点,通过环境法律生态化理念与民法的良性互动,将生态理念拓展到民法领域。《中华人民共和国民法典》的出台,为生态环境保护提供了新契机:立法层面,“自由”与“绿色限制”的对话,系统完备的“绿色条款”体系拓展了民法的生态维度;理论层面,民法生态化的理论变迁与调整,使民法基本原则和制度的生态内涵不断加深;实践层面,充分发挥环境资源审判作用,打造生态环境“司法品牌”,为推进生态文明建设贡献力量。There is no substitute for ecological environment,which seems so cheap but hard to recover.Ecologicalization of law is a good prescription for solving environmental problems by integrating ecological thinking,legal thinking,and ecological civilization concept.Starting from the theory of ecologicalization of law,the ecological concept is expanded to the field of civil law through the positive interaction between the concept of ecologicalization of ecological law and the civil law.The promulgation of the Civil Code of the People’s Republic of China provides a good opportunity for ecological and environmental protection:at the legislative level,the dialogue between“freedom”and“green restriction”,and the systematic and complete“green clause”system expand the ecological dimension of civil law;At the theoretical level,the theoretical change and adjustment of the ecologicalization of civil law have deepened the ecological connotation of the basic principles and institutions of civil law;And at the practical level,the function of environmental resources trial is given full play,the“judicial brand”of ecological environment is created,so as to contribute to the construction of ecological civilization.
