听证制度在农业行政处罚中的适用——以梁磊诉宿州市埇桥区农业农村局案为例

摘　　要：行政处罚中的听证制度是指行政主体对相对人作出较大数额罚款、吊销许可证或执照等行政处罚决定前,告知相对人和利害关系人就处罚依据、相关法律与案件事实能进行质证、申辩与听取陈述的权利。它是国家赋予相对人维护辩护权利,表达诉求的一种重要制度安排。1996年的《行政处罚法》,2020年新修订的《农业行政处罚程序规定》都规定了听证制度,经过发展虽不断完善,但囿于立法技术和理念的局限性,听证制度在实践应用中逐渐暴露出诸多不足与缺陷。在农业领域中,行政处罚数额一般较大,听证制度适用比较普遍。因此,规范、完善听证制度在农业行政处罚中的适用,不仅保障行政相对人的权利,同时也有利于提高行政机关决策的合法性,监督行政权力。The hearing system in administrative punishment means that before the administrative subject makes a large fine, revokes a permit or license and other administrative punishment decisions on the counterparty, it informs the counterparty and interested parties that they can proceed on the basis of punishment, relevant laws and facts of the case. The right to cross-examine, defend and hear statements. It is an important system that the state grants the counterparty the right to defend and express their demands. The 1996 Administrative Punishment Law and the newly revised Agricultural Administrative Punishment Procedure Regulations in 2020 both provide for the hearing system. Although it has been continuously improved after development, it is limited by the limitations of legislative techniques and concepts. The application gradually revealed many shortcomings and defects. In the agricultural field, because the amount of administrative penalty is generally large, the application of hearings is more common. Therefore, standardizing the hearing procedures and improving the application of the hearing system in agricultural administrative punishments not only protect the rights of administrative counterparts, but also help improve the legitimacy of administrative organs’ decision-making and supervise administrative powers.
