论海南自由贸易港立法权的创设  

On the Establishment of the Legislative Power of Hainan Free Trade Port

摘　　要：作为"境内关外"和高标准对外开放的海南自由贸易港,面临诸多制度创新带来的立法需开求,这。当三前种海途径南均自存由贸在易一定港的立局法以限中,而央创立设法海权南、自地方由立贸法易港权立和《法立权法是法解》决第1现3有条立授法权困立境法的三最种佳途选径展择。海南自由贸易港立法权本质上应属于地方立法权和授权立法权。虽然《海南自由贸易港法(草案)》第10条创设了海南自由贸易港立法权,但该条设立的制度体系还存在若干问题。海南自由贸易港立法权应通过双重法条授权的方式产生,受权主体应为海南省人大及其常委会和海南省人民政府,权限范围应为未来《海南自由贸易港法》中被明确授权的法律保留事项,监督方式应采用备案审查。Hainan Free Trade Port, which is"outside the customs and within the boundary"and with high standards of opening-up to the outside world, face many legislative challenges out of the institutional innovation. At present, the legislation for Hainan Free Trade Port abides by the authorization legislation from the central legislative power, the local legislative power and Article 15 of the Legislation Law of the People’s Republic of China. However, there are some limitations in these three approaches, and the creation of the legislative power of Hainan Free Trade Port is the best choice to solve the existing legislative dilemma. The legislative power of Hainan Free Trade Port is essentially the local legislative power and that of authorization legislation. Although Article 10 of Hainan Free Trade Port Law of the People’s Republic of China(Draft) creates the legislative power of Hainan Free Trade Port, there are still several problems with the institutional system established by this article.The legislative power of Hainan Free Trade Port should be generated through the dual legal authorization of the Hainan Provincial People’s Congress and its Standing Committee, as well as Hainan Provincial People’s Government. The scope of authority should be the legal reservations that are explicitly authorized in the future Hainan Free Trade Port Law of the People’s Republic of China, and the supervision method should adopt the record review.
