军用标准必要专利问题研究

摘　　要：军用标准建用统一的特点,要求军用标准化主管部门在标准必要专利问题上,相比于普通标准组织采取更为积极的立场。本文基于对国内外标准必要专利相关法规制度的深入分析,从军用标准的特殊性出发,研究范围涉及军用标准必要专利的信息披露政策、必要性确定规则及实施许可政策等核心问题及解决方案,建议标准起草人承担更为充分的专利信息披露义务,军用标准化主管部门对专利披露信息和专利必要性进行审查、对专利实施许可费的确定提供具体化的指导或规定,并对专利实施许可政策执行过程进行监督和纠纷调解。The characteristics of unified construction and use of military standards require the competent department of military standardization to take a more active position than ordinary standard organizations on the issue of necessary patents. Based on the in-depth analysis of the relevant laws and regulations of domestic and foreign standard essential patents, starting from the particularity of military standards, the research scope involves the core issues and solutions of information disclosure policy, necessity determination rules and implementation license policy of military standard essential patents. It is suggested that the standard drafters should undertake more full patent information disclosure obligations. And the competent department of military standardization should examine the information of patent disclosure and the necessity of patent, provide specific guidance or regulations for the determination of patent licensing fee, and supervise the implementation process of patent licensing policy and mediate disputes.
