检察指导案例适用性问题研究

摘　　要：最高人民检察院关于案例指导工作的规范性文件已出台十年之久,但检察指导性案例适用的情况却并不乐观,尤其是相比最高人民法院指导性案例的适用情况。究其原因,是检察指导性案例的内在逻辑缺乏统一性,宣传功能和适用功能未能很好发挥,文本格式存在问题,适用空间狭窄。2019年发布的两批指导性案例有着明显的改善与进步,建立在“四大检察”布局下的新型指导性案例正在形成。当今问题在于一方面要使检察机关的隐性适用纠正为显性适用,加强相关文书说理,并以文书的形式表现出来;另一方面要使法官、律师等法律职业共同体亦能使用检察指导性案例进行法律适用,进而增强检察指导性案例的生命力。The normative documents on procuratorate case guidance were issued ten years ago.However,compared with the application of the Supreme Court's guiding case,the application of the procuratorial guiding case is not optimistic.The reason is that the internal logic of the guiding case is not unified,the propaganda function and the applicable function are not well carried out,there are problems with the text format,and there is not much room for the application of the procuratorial guiding case.The two batches of guiding cases issued in 2019 have shown marked improvements and progress,and the case guiding system under the requirements of the"four major procuratorial functions"is being formed.The current problem is that the implicit application of the procuratorial organ must be corrected to the explicit application,and the document logical should be strengthened and expressed in the form of documents;moreover,it is necessary to enable legal professional communities such as judges and lawyers to use procuratorial guidance cases for legal application,so that procuratorial guidance cases can be continuously developed and improved.
