论区块链存证的模式——“第三方存证”与“自主存证”之比较

摘　　要：区块链存证技术采用了突破性的技术方案,能够有效保障电子数据的真实性,在司法实践中逐步推广应用。人民法院在试点区块链存证的过程中探索出了两种不同的模式:一是“第三方存证”,诉讼当事人必须向人民法院指定的数据服务商购买服务,并由服务商代为存证。二是“自主存证”,诉讼当事人可以以自己的名义接入区块链并自主存证;无须借助第三方。比较来看,自主存证模式可以有效防止信息泄露,有利于当事人平等地使用区块链存证技术,并且能够适应多种应用场景,因此在安全性、公正性、实用性等方面均有优势,应当作为区块链存证的基本模式。在确立“自主存证”模式的基础上,为了提升区块链存证的安全性、统一区块链存证的规则,建议最高人民法院在总结试点经验的基础上主导建设“全国法院统一证据平台”。As blockchain technology adopts a ground-breaking technical solution and can guarantee the authenticity of electronic data,it is gradually applied in judicial practice.The People s court has explored two different models in the application of blockchain deposit:the first is“third-party depositing”,in which the litigant must purchase the service from the data service provider established by the people s court,and the service provider will store the certificate on its behalf.The second is“independent deposit”,where litigants can access the blockchain in their own name and deposit their own certificates without the help of a third party.By comparison,the independent certificate depositing mode can effectively prevent information leakage,promote the equal use of blockchain technology,and is adaptable in a variety of application scenarios.Therefore,it has advantages in terms of security,fairness,practicability.In order to improve the security and unify the rules of blockchain deposit,we suggest that the Supreme People s Court takes the lead in building a“National Court Unified Evidence Platform”based on the experience of the pilots.
