摘　　要："兄弟关系精神"是《世界人权宣言》第1条所提出的关于人权的重要概念,它和自由、平等及尊严共同构成现代国际人权的价值基石。"兄弟关系精神"与法国大革命提出的"博爱"口号,以及北美清教伦理中的"兄弟之爱"有着紧密联系,它在《世界人权宣言》中的确立是多元文化碰撞的产物。作为人类东西方文明所共同接受的价值共识,"兄弟关系精神"旨在推动和促进《世界人权宣言》的起草,同时突显人权的义务属性。"兄弟关系精神"被引入《世界人权宣言》的价值意涵包括:尊重人的基本权利和尊严;促进"人类家庭"的构建;为普遍人权的确立提供情感支撑。The"spirit of brotherhood"is an important concept of human rights proposed in Article 1 of the Universal Declaration of Human Rights.It constitutes the valuable cornerstone of modern international human rights together with freedom,equality,and dignity.The"spirit of brotherhood"is closely related to the slogan of"fraternity"put forward by the French Revolution and the"brotherly love"in the American War of Independence.Its establishment in the Universal Declaration of Human Rights is a result of a multicultural clash.As a value consensus reached by both Eastern and Western civilizations,the"spirit of brotherhood"aims to promote and advance the formulation of the Universal Declaration of Human Rights while highlighting the nature of human rights as an obligation.The value significance of the"spirit of brotherhood"being incorporated into the Universal Declaration of Human Rights includes:respecting the basic rights and dignity of human beings;promoting the building of the"human family";and providing emotional support for the establishment of universal human rights.
