摘 要:2015年《立法法》的修改赋予自治州地方立法权,自治州由此兼具自治立法权和一般地方立法权。《立法法》赋权六年来,自治州的地方立法活动显现出越权立法、重复立法、立法权限不清、整体立法进度滞后等诸多问题。可通过由上级立法机关提供上位法依据,厘清自治州一般地方立法权和自治立法权的权限划分,以及地方性法规和地方政府规章的权限划分,加强对自治州地方立法的合法性审查等方面规范自治州立法活动,促进自治州立法实践良性发展。Amendments to the Legislative Law of 2015 confer local legislative power on autonomous prefectures. Since then, autonomous prefectures have both autonomous legislative power and general local legislative power. Over the past six years, local legislative activities in autonomous prefectures have shown many problems, such as ultra vires legislation, repeated legislation, unclear legislative authority and lagging overall legislative progress. By providing the superior legal basis by the higher legislative organs, clarifying the division of the general local legislative power and the autonomous legislative power of autonomous prefectures, clarifying the division of the local laws and local government regulations, strengthening the legitimacy of local legislation to regulate autonomous prefecture legislative activities, we can promote the healthy development of autonomous prefecture legislative practice.
