平台型灵活就业的劳动关系研究——以外卖骑手为例

摘　　要：随着互联网信息技术的迅猛发展,平台型灵活就业作为重要的新就业形态之一,一方面大大促进了劳动就业,另一方面也存在较多亟待研究和解决的问题。以外卖骑手为例,平台型灵活就业由于劳动关系模糊、参与主体权责不清、无集体协商机制等特点,导致外卖骑手地位太过弱势、名义工资高而实际工资低、对劳动者隐性控制严格、平台企业的机会主义行为明显等问题。为构建和谐劳动关系,推动平台型灵活就业健康持续发展,政府应完善相关政策法规和管理制度,加强平台企业监管和劳动者权益保护;应探索建立平台型就业者的工会组织,为劳动者维权提供组织基础;平台企业应转变"用工"理念,改善就业者的安全和保障性待遇;劳动者自身应提升认识水平,增强维权意识。With the rapid development of Internet information technology, platform-type flexible employment has become an important new way of employment. Although this employment mode promotes employment, it also has many problems to be dealt with. Taking the delivery couriers as an example,platform-type flexible employment has ambiguity of labor relations. The rights and responsibilities of participants are unclear. Nominal wages for this group are high and real wages are low. Enterprise management is too strict. In order to build harmonious labor relations and promote the healthy and sustainable development of platform-type flexible employment, the government should improve relevant policies, regulations and management systems, strengthen supervision of platform-type companies and protection of workers’ rights and interests.Second, we should explore the establishment of trade union organization of platform workers. It provides an organizational basis of protecting the rights of workers. And platform-type companies should think more from the perspective of workers and change the situation for workers. In addition, the workers themselves should enhance the level of understanding, enhance the awareness of rights protection.
