公平博弈与拆迁秩序——基于两种拆迁补偿模式的比较分析

摘　　要：权利政治与利益博弈是研究农民维权的主导视角,但这两者并未更进一步关注农民行动的伦理逻辑。通过将公平价值纳入到国家与农民的互动关系中,建立以利益分配均衡性为分析基础的公平博弈模型,本文试图扩展农民维权行为的解释维度。研究发现,国家能够塑造社会内部的利益分配关系,农民基于所处利益关系的均衡度进行公平感知,做出博弈选择。保障型安置与市场价值补偿是当前主导的拆迁补偿模式,前者强调居住权公平,塑造了高度均衡的利益分配关系,农民的公平感较强并倾向进行有限博弈;后者强调对价公平,塑造低度均衡的利益分配关系,这激发了农民的非公平厌恶与普遍博弈。农民的博弈选择将持续影响拆迁政策的落实,形塑出差异化的拆迁秩序。公平博弈模型有助于更好地理解农民的行为逻辑,拓展对国家与社会关系的分析,并为合理拆迁政策的制定提供启示。Political struggle and interest game are the dominant perspectives in the research of farmers’ rights protection, but they do not pay more attention to the ethical logic of farmers’ actions. By incorporating fair value into the interactive relationship between the state and farmers, this article attempts to expand the explanatory dimension of farmers’ rights protection behavior. It finds that the state can shape the interest distribution relationship within the society, and farmers perceive fairness based on the equilibrium degree of the interest relationship and make game choices. The compensation-priority and the resettlement-priority are the dominant modes of demolition compensation. The former emphasizes the fairness of the right of residence and creates a highly balanced distribution of interests. That gives farmers a strong sense of fairness, driving them to play limited games. The latter emphasizes the fairness of consideration and shapes a low balanced interest distribution relationship, which stimulates farmers’ aversion to unfairness and universal game. The game choice of farmers will continue to influence the implementation of demolition policies and shape a dissimilated demolition order. The fair gambling model is helpful to better understand the behavior logic of farmers,expand the analysis of the relationship between the state and society, and provide enlightenment for the formulation of reasonable demolition policies.
